The rules and conditions under which a Guardian Ad Litem can be appointed by the court are dictated by the Virginia Code §16.1-266. In Virginia, your child’s Guardian Ad Litem is a lawyer who completes specialized training in order to represent children and incapacitated adults.

While most Guardian Ad Litems are appointed by the court, Guardians can also be used to represent the interests of a child or an incapacitated adult with certain permissions from the court and only in certain cases.
